Telstra EBA Campaign - The stoppage action continues

The stoppage action continues.

Overtime and recall bans also continue indefinitely across our membership.

- In our view, Telstra is not entitled to dock members who took short stoppages, (less than 4 hours), 4 hours pay as a “fine”, simply because they consider those short stoppages to be unprotected action.

- At the time the action was taken, it was considered to be legal, protected action and it was confirmed to be so by Fair Work Australia Vice-President Lawler on the 4th December 2009. Even though the Full Bench of FWA overturned the Lawler decision on the 15th December 2009, the CEPU had been operating on the basis that the industrial action was considered to be protected action up to that date. The Full Bench issued no orders regarding any industrial action. Based on the Full Bench proceedings the CEPU has since changed the industrial action notice wording to incorporate the Full Bench considerations.

- In any event, the CEPU will explore all legal options against the Telstra docking action.
Those members who have been docked 4 hours pay for a stoppage of less than 4 hours should email the CEPU, if they haven’t already done so, with details of the docking action taken against them. (Dates, times, work area, contact details.)

- The CEPU will continue to notify EBA claim industrial action up to and including beyond the Christmas/New Year break period. Even though this is normally a period of reduced activity across the board, we intend to keep the pressure on, in various ways.

CEPU WELFARE FUND - Members who are not involved in the key area action, should donate to the CEPU Member Welfare Fund to help sustain those members who are out on strike for extended periods in the key areas.
